Types of Drug Crimes

Drug crimes can be found in K.S.A. 21-5701 through 21-5717. Drug crimes in Kansas can be broken into the following broad categories:

–Possessing Unlawful Drugs with Intent to Distribute
–Possession of Unlawful Drugs.
Punishments for Drug Crimes
Minor drug crimes, like possession of marijuana, can carry jail time of up to 6 months and/or a fine if it is your first offense. Other minor drug crimes carry jail time of up to 12 months and/or a fine. Those crimes are usually misdemeanors.
Felony drug possession can carry up to 34 months in the Kansas Department of Corrections. However, on a first offense and if other criteria are met, you could receive mandatory drug treatment instead of an immediate prison sentence.
Possessing unlawful drugs with intent to distribute or selling/distributing/cultivating/manufacturing unlawful drugs can be punished by up to 204 months prison, depending on the quantity of the drugs.
